ARE THERE ANY VALID DEFENSES TO THIS NOTICE OF VIOLATION?
  • STOLEN VEHICLE OR REGISTRATION PLATES: You are not liable if your motor vehicle and/or registration plates was/were stolen before the violation occurred and was/were not under your exclusive control at the time of the red light signal violation.  To assert this defense, you must produce a certified copy of the police report concerning the stolen motor vehicle and/or license plate.
  •  EMERGENCY VEHICLE/FUNERAL PROCESSION: You are not liable if the driver of the vehicle passed through the inter-section when the light was red either (i) to yield the right-of-way to an emergency vehicle, or (ii) as part of a funeral procession.
  • PROCEEDING AT THE DIRECTION OF A POLICE OFFIER:  You are not liable if the driver of the vehicle passed through the intersection when the light was red at the direction of a police officer acting within the scope of his duties.
  • UNIFORM TRAFFIC CITATION FOR SAME VIOLATION: You are not liable if the driver of the vehicle received a Uniform Traffic Citation from a police officer for the same violation.
WHAT IF I DO NOT PAY THE FINE?

FAILURE TO PAY THE PENALTY SHOWN, OR TO CONTEST LIABILITY MAY RESULT IN THE REFUSAL OR SUSPENSION OF YOUR MOTOR VEHICLE REGISTRATION. YOUR ACCOUNT WILL BE TURNDE OVER TO A COLLECTION COMPANY WHICH MAY REORT YOUR DELIQUENCY TO CREDIT REPORTING AGENCIES AND YOU MAY BE SUBIECT TO COURT COLLECTION ACTION.
HOW DOES IT WORK? 

The red light photo enforcement system measures your speed as you approach the signal.  If your speed indicates that you are unlikely to stop before the signal changes to red, it captures a digital photograph of your vehicle behind the stop bar.  If you subsequently travel past the stop bar while the signal is red, it captures a second photograph of your vehicle in the inter-section and extracts the image of your license plate.  The system also captures a motion video of the event which you can review online.  An East St Louis police officer reviews every single violation.

HOW DO I CONTEST A NOTICE OF VIOLATION?
  • EAST ST. LOUIS RESIDENTS:  If you reside in the City of East St. Louis, you may request an administrative hearing on or before the due date specified on the face of this Notice by calling East St. Louis Photo Enforcement Program Customer Service Call Center toll free at 8(866)-247-8157 between 9:00 AM and 4:00 PM (CT), Monday through Friday.  You will be mailed confirmation of your hearing date in the mail.  Failure to show up at your hearing will constitute a waiver of your right to contest the Notice and an admission of liability.  You will be mailed a notice of your hearing date (which shall be no fewer than 15 nor more than 30 days after your request), time and location.
  • NON-EAST ST. LOUIS RESIDENTS:  Non-East St. Louis residents may contest the Notice of Violation by mailing an Affidavit of Non-Liability to Automated Enforcement Division, PO Box 593095 Orlando, FL 32809-3095.  The Affidavit must be sworn before a Notary Public and submitted together with all supporting documentation and re-ceived on or before the due date specified on the face of this Notice.
  • AFFIDAVIT OF NON-LIABILITY: You may obtain a form of Affidavit of Non-Liability at the bottom of this page or by visiting the East St. Louis Police Department.
  • DISABILITY ACCOMMODATION: Both the District Court and the City of East St. Louis will make any reasonable accommodation for persons with disabilities. Requests should be directed to the appropriate agency prior to visiting the facility.
